Terms of service.
The terms for using this website, requesting a consultation and using the tools we link to.
These Terms of Service (“Terms”) govern your use of the website operated by Westlake Medical Aesthetics (“we,” “us” or “our”) at westlaketxmedspa.com (the “Site”).
By using the Site, sending us information, requesting a consultation or contacting us electronically, you agree to these Terms. If you don’t agree, please don’t use the Site. We may update these Terms from time to time. When we do, we will post the new version here with a new effective date. If you keep using the Site after that, you accept the updated Terms.
01Eligibility and use of the Site
You must be at least 18 years old, or have a parent or legal guardian involved, to request a consultation or send us information through the Site.
You agree to use the Site only for lawful purposes, and not in any way that interferes with how it works, its security, or its accessibility for others.
02Information only, not medical advice
The Site gives general information about our practice, our treatments, how often they are usually repeated and how to pay for them. Everything on it is for general information and education only. It does not replace an in-person assessment, a diagnosis or a treatment plan from a licensed medical provider.
Using the Site does not make you our patient. That relationship starts only when our office accepts you as a patient and you receive care from our medical providers.
What the Site says about who a treatment suits, how long results take to show, how long they last and how much downtime to expect is general. Your own suitability and plan can only be decided at a consultation.
If you have a medical emergency, including a reaction after a treatment, call 911 or your local emergency number. Don’t rely on the Site, email or social media messages for urgent care.
03Consultation requests and scheduling
You can ask for a consultation through the Site, in person or by video. Sending a request does not guarantee an appointment. An appointment is confirmed only after our office checks availability and contacts you.
You agree to give us accurate, current and complete information. We may change, reschedule or decline a request because of our providers’ availability, scheduling conflicts, missing information, whether the treatment is clinically appropriate for you, or other reasonable considerations.
04Virtual consultations and photos
If you ask for a video consultation or send us photos, you confirm that you have the right to share those images.
A virtual consultation gives a preliminary, non-diagnostic opinion only. It does not replace an in-person assessment. Any recommendation made by video may change once one of our providers has seen you in person, and treatment is only given after that.
05Sensitive information and communications
Website forms, email and social media messages are for routine questions and appointment requests. Please don’t send sensitive medical or financial information through them. For anything involving your health information, call our office or use a secure channel we give you.
When you give us your contact details, you agree that we can contact you by phone, voicemail and email about your request, your appointments and your treatment. This includes confirmations and reminders, aftercare instructions and follow-ups. We will only send you marketing if you have agreed to receive it, and you can stop it at any time.
Email and other electronic messages are not always fully secure and can be intercepted. Please keep that in mind before you share sensitive information that way. Information you give us as a patient is governed by our Notice of Privacy Practices under HIPAA, which you can get at our office or by asking us.
06Financing and payment tools
The Site links to financing offered by independent companies, such as Cherry and CareCredit. That financing is provided by those companies, not by Westlake Medical Aesthetics.
We don’t control approvals, application results, credit requirements, payment terms, lending terms or promotions. Please take any questions about a financing decision, account or payment to the financing company.
Treatment prices are confirmed at your consultation, before you agree to any treatment.
07Membership
The membership described on the Site is a summary. Joining requires a signed membership agreement, and that agreement sets out the monthly fee, the minimum commitment, the notice needed to cancel, what is included and how your membership balance works. If the Site and your signed agreement ever differ, the agreement applies.
08Your responsibilities
When you use the Site or contact our office, you agree to:
- Give true, accurate and complete information, including contact details that belong to you
- Use the Site only for genuine personal or patient purposes
- Not send false, misleading or unauthorized requests, including requests made on behalf of someone who hasn’t agreed to it
- Not try to disrupt, damage, disable, reverse engineer or gain unauthorized access to the Site or any connected service
- Tell us if your contact details change and you still want to hear from us about your appointments
09Intellectual property
Everything on the Site, including text, graphics, logos, icons, photographs, before-and-after images, videos, page layouts and design, is owned by or licensed to Westlake Medical Aesthetics and protected by intellectual property laws.
You may not copy, reproduce, republish, distribute, change, display, transmit or otherwise use anything from the Site without our written permission. The exception is limited personal, non-commercial use, such as printing a page for your own reference.
Product and brand names mentioned on the Site, such as Botox, Xeomin, Dysport, Jeuveau, Sculptra, Morpheus8, SkinPen and HydraFacial, are trademarks of their respective owners. We use them only to describe the treatments we offer.
10Third-party services and links
Some features and links on the Site are provided by other companies, including financing providers, Google Maps, Google reviews, Instagram and TikTok, and the platform used for video consultations. The Site also links to Stone Surgical Arts, which is a separate practice. These companies have their own terms and privacy policies, and a link does not mean we endorse or control them. We are not responsible for their availability, accuracy, content, security or practices.
11Medical disclaimer
Nothing on the Site is medical advice, and you should not rely on it instead of professional care. Results vary from person to person. Before-and-after photos and reviews show the results of particular patients. They do not promise or guarantee what your results will be. Always talk to a licensed medical provider about your diagnosis, treatment options and care.
12Disclaimer of warranties
The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We work to keep the Site accurate and working, but we don’t guarantee that it will always be available, that its content will be current, complete or error-free, or that third-party tools will work without problems. You use the Site at your own risk.
13Limitation of liability
To the fullest extent the law allows, Westlake Medical Aesthetics and its owners, employees and affiliates are not liable for any direct, indirect, incidental, consequential, special or punitive damages arising from or related to: your use of the Site, or not being able to use it; errors or omissions in its content; delays or failures in communication; technical problems or interruptions; unauthorized access to information you send; or your use of third-party services linked from the Site.
This section does not limit any liability that the law does not allow to be limited, and nothing in these Terms limits liability arising from the clinical care we provide.
14Indemnification
You agree to defend, indemnify and hold harmless Westlake Medical Aesthetics and its owners, employees and affiliates against any claims, damages, losses, liabilities and expenses, including reasonable attorneys’ fees, that arise from your breach of these Terms, your misuse of the Site, or your breach of any law or of anyone else’s rights.
15Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site must be brought only in the state or federal courts in Tarrant County, Texas, and you agree to the personal jurisdiction of those courts.
16Severability, waiver and entire agreement
If any part of these Terms is found to be unenforceable, the rest stays in full effect. If we don’t enforce a provision, that does not waive it or any other provision.
These Terms and our Privacy Policy are the entire agreement between you and Westlake Medical Aesthetics about your use of the Site. They replace any earlier agreements on the same subject. They do not replace a membership agreement or treatment consent you sign with us.
17Changes to these Terms
We may change these Terms at any time by posting an updated version on this page. The changes take effect from the effective date shown at the top. Please check this page from time to time.
